Physician abortion reports filed with the Department of Health are made confidential and exempt from public records disclosure under Florida's public records law and state constitution

Reports may only be disclosed to the Attorney General or state attorney during criminal investigations, or pursuant to a court order in related legal actions

The exemption applies retroactively to all reports filed before, on, or after January 1, 2020

The exemption is subject to the Open Government Sunset Review Act and will automatically repeal on October 2, 2024, unless the Legislature reenacts it

The Legislature declares protecting these reports is a public necessity to safeguard health care privacy rights and prevent unwarranted damage to individuals' privacy and reputation
