CS for SB 1362 - Community Associations

• Exempts property association pools with 32 or fewer units or parcels from Department of Health regulation, except for water quality requirements.

• Prohibits insurance policies issued to individual condominium unit owners from including subrogation rights against the condominium association.

• Requires associations to maintain bids for work and materials for at least 1 year after receipt, and allows members to use portable devices (phones, tablets, scanners) to copy official records without association charges.

• Specifies that only board service occurring on or after July 1, 2018 counts toward the 8-year consecutive term limit for board members, and revises recall procedures to streamline the process.

• Allows parties in homeowners' association disputes to mutually select mediators or arbitrators who are not certified by the Florida Supreme Court, and extends the response period for presuit mediation demands from 20 to 30 days.
