Local governments must adopt a resolution of intent at least 180 days before displacing a private waste company, which must include specific goals, franchise fee justification, and be published in the official newspaper with notice of a public hearing.

Local governments must develop a detailed plan for organized collection service within 90 days of adopting the resolution of intent, with mandatory participation from all existing waste collection licensees and operators.

Local governments cannot commence organized collection service for at least 5 years after adopting an ordinance or resolution establishing such service, and cannot displace any licensed solid waste collectors during this period.

If a local government fails to implement an organized collection service within 1 year after passing a resolution of intent, the entire process must be restarted from the beginning.

"Organized collection service" is defined as a system for collecting solid waste and recyclables through franchise arrangements or consolidation from multiple haulers to a single contracted hauler in a defined geographic area.
