SB 1780 - Adult Use Marijuana Legalization

• Legalizes recreational marijuana for adults 21 and older, allowing possession of up to 2.5 ounces, cultivation of up to 6 plants, and transfer of marijuana without payment to other adults.

• Establishes Division of Alcoholic Beverages, Marijuana, and Tobacco to license and regulate four types of marijuana establishments: cultivation facilities, testing facilities, product manufacturing facilities, and retail stores.

• Limits retail marijuana stores based on local population (1 store per 5,000 people in localities over 20,000; 2 stores in localities of 5,001-20,000; 1 store in localities of 2,000-5,001).

• Imposes excise tax on marijuana sales with 15% of revenue transferred to the Alcoholic Beverage, Marijuana, and Tobacco Trust Fund and 5% of revenue dedicated to marijuana research until January 1, 2028.

• Allows municipalities to prohibit marijuana establishments or set lower limits through local ordinance and permits localities to issue licenses if the Division fails to process applications by specified dates.

• Prohibits minors from possessing or purchasing marijuana with civil penalties of $200-$600 for false identification use; protects employer drug policies and operating-under-influence laws.
