CS/HB 177 - Prescription Drug Donation Repository Program

• Creates the Prescription Drug Donation Repository Program within the Department of Health to facilitate donation of prescription drugs and supplies to eligible patients who are indigent, uninsured, or underinsured.

• Authorizes eligible repositories (pharmacies, health care practitioner offices, hospitals, nursing homes, and free/nonprofit clinics) to accept and dispense donations after notifying the department and designating a licensed pharmacist responsible for inspection.

• Specifies eligible donors (nursing homes, hospices, hospitals, pharmacies, drug manufacturers, wholesale distributors, and prescribers) and requires donations to be in unopened, tamper-evident packaging with expiration dates at least 3 months away and no signs of tampering.

• Requires repositories to maintain monthly inventory records submitted to the department by the 5th of each month, establish drug recall notification protocols, and destroy recalled or expired medications.

• Provides immunity from civil, criminal, and professional disciplinary liability for program participants and donors exercising reasonable care, and allows the Governor to waive patient eligibility requirements during declared states of emergency.
