HB 289 Summary: "Jaime's Law"

• Requires background checks for ammunition sales and transfers through licensed dealers, expanding existing firearm background check requirements to include ammunition purchases.

• Establishes a maximum fee of $8 per transaction (subject to reduction based on federal funding) collected from ammunition purchasers to fund the criminal history check system.

• Exempts certain individuals from background check requirements including concealed weapons/firearms license holders, law enforcement officers, correctional officers, and correctional probation officers.

• Creates exceptions for ammunition transfers at shooting ranges, and for hunting, trapping, or fishing when the transferor has no reason to believe the transferee will use ammunition illegally.

• Establishes criminal penalties including third-degree felonies for providing false information during purchases, dealers violating requirements, and knowingly acquiring ammunition for prohibited persons; effective October 1, 2020.
