HB 331 Summary

• Public schools may purchase naloxone from wholesale distributors or enter into arrangements with distributors or manufacturers to obtain naloxone at fair-market, free, or reduced prices for treating student opioid overdoses.

• Naloxone must be stored in a secure location on school premises and administered according to a protocol developed by a licensed physician.

• School personnel administering naloxone must be trained to recognize opioid overdoses and follow the standing protocol in their professional judgment that an overdose is occurring.

• School districts, employees, agents, and the physician providing the protocol are immune from liability for injuries resulting from naloxone administration if trained personnel follow the protocol, except when personnel act willfully and wantonly.

• Liability immunity applies regardless of whether parents, guardians, or the student's medical providers have provided authorization or notice.

• The act takes effect July 1, 2020.
