Creates certificate-of-need exemption for new intermediate care facilities for the developmentally disabled with 24 total beds (three 8-bed homes) serving individuals with severe maladaptive behaviors and co-occurring psychiatric diagnoses

Agency for Health Care Administration may grant no more than three exemptions, with no specific legislative appropriation required

Applicants must have at least 10 years of Florida experience serving individuals with severe maladaptive behaviors and no license denied, revoked, or suspended within the preceding 36 months

Facilities must provide 24/7 medical and nursing services, prohibit mechanical restraints, and designate minimum 16 beds for individuals scoring Level 4-6 on the Global Behavioral Service Need Matrix

Exemptions terminate 18 months after issuance unless construction has commenced; provisions are subject to repeal July 1, 2022 unless reviewed and saved by the Legislature
