Summary of Florida HB 1389 (2020) - Availability of Marijuana for Adult Use

• Adults 21 and older would be permitted to purchase up to 2,000 milligrams of THC in marijuana products, 2.5 ounces of smokable marijuana, and marijuana delivery devices from licensed medical marijuana treatment centers (MMTCs) registered for adult-use sales

• Medical marijuana treatment centers would operate under a restructured licensing system requiring separate cultivation, processing, retail, and transportation licenses, with facility permits required for each location and biennial inspections by the Department of Health

• Individuals convicted of possessing 4 ounces or less of cannabis under previous law would be eligible for sentence review hearings and potential resentencing, with those whose conduct is no longer criminal entitled to release and waiver of related fines and fees

• Criminal records for cannabis possession of 4 ounces or less could be expunged upon petition, allowing individuals to lawfully deny the arrest or conviction in most circumstances after obtaining a certificate of eligibility from the Department of Law Enforcement

• Counties and municipalities could prohibit dispensing facilities but could not ban deliveries to qualified medical patients, and the Department of Agriculture would be required to study allowing private cultivation of marijuana by January 1, 2021
