CS for SB 58: Prescription Drug Donation Repository Program

• Creates the Prescription Drug Donation Repository Program within the Department of Health to facilitate donation of prescription drugs and supplies to indigent, uninsured, or underinsured residents of Florida who have valid prescriptions.

• Establishes eligible donors (nursing homes, hospices, hospitals, pharmacies, manufacturers, distributors, and prescribers) and eligible drugs (FDA-approved, unopened, tamper-evident packaging, room temperature storage, expiration date more than 3 months away) while prohibiting donations of controlled substances and drugs with FDA Risk Evaluation and Mitigation Strategies.

• Requires licensed pharmacist inspection of all donations and establishes centralized and local repository requirements for secure storage, inventory maintenance, and notification procedures within 5 days of receipt.

• Authorizes repositories to charge patients a nominal handling fee but prohibits sale or resale of donated drugs and prohibits claiming reimbursement from insurance or Medicaid for donated prescription drugs dispensed under the program.

• Provides immunity from civil, criminal, and professional disciplinary liability for donors and program participants who exercise reasonable care, and allows the Governor to waive patient eligibility requirements during declared states of emergency.
