Creates section 791.08, Florida Statutes to establish an exemption allowing fireworks use solely and exclusively during three designated holidays: New Year's Day (January 1), Independence Day (July 4), and New Year's Eve (December 31)

Does not provide comprehensive regulation of fireworks or supersede existing local government regulations regarding fireworks use

Preserves homeowners' association rights to enforce existing covenants or declarations that prohibit fireworks, provided those documents were legally executed and properly recorded

Prohibits homeowners' associations from adopting new board rules that would abrogate a homeowner's right to use fireworks during designated holidays or under general law

Takes effect upon becoming law
