SB 694 Summary

• Expands the definition of "tobacco products" to include electronic smoking devices, e-liquid, dissolvable tobacco, nicotine gel, and components or accessories used in consumption of tobacco products.

• Prohibits the sale or delivery of tobacco products except in direct, face-to-face exchanges with a dealer or agent; eliminates previous allowance for vending machine sales with lockout devices.

• Creates new prohibition on the sale of flavored e-liquid, defined as e-liquid with taste or smell other than tobacco (including fruit, menthol, mint, chocolate, candy, dessert, or alcoholic beverage flavors).

• Changes requirement that dealers "may require" proof of age to dealers "shall require" proof of age before selling tobacco products.

• Repeals section 877.112 relating to nicotine products and nicotine dispensing devices, effective July 1, 2020.
