Requires evidence of medical expenses in personal injury claims to be based on usual and customary charges in the community where expenses are or will be incurred

Allows charges from an independent, nonprofit benchmarking database (501(c)(3) status, in existence for at least 5 years) to be admitted as evidence of usual and customary medical charges for claimants with public or private health insurance

Permits consideration of reasonableness along with other relevant evidence when determining damages for future medical expenses

Prohibits usual and customary charges from including increased or additional charges based on litigation outcomes

Effective date of July 1, 2020
