Person whose arrest booking photograph is published may request removal in writing to the registered agent, which must be removed within 10 calendar days without charge.

Prohibits republishing or redisseminating a photograph that was previously removed, with violators subject to civil action and $5,000 per day penalty for noncompliance.

Allows civil action if photograph is not removed within 10 calendar days of written request, with court imposing $1,000 per day penalty for noncompliance and awarding reasonable attorney fees and court costs.

Refusal to remove or republishing arrest booking photographs constitutes an unfair or deceptive trade practice under Florida law.

All civil penalties recovered are deposited into the General Revenue Fund, effective July 1, 2021.
