CS/CS/HB 987 - Tobacco and Nicotine Products Summary

• Raises the minimum purchase age for tobacco and nicotine products from 18 to 21 years old across all sales, including mail order, Internet, and remote sales.

• Creates comprehensive regulatory framework for nicotine products by establishing Part II of Chapter 569, including permit requirements for retail nicotine product dealers, restrictions on self-service sales, and prohibitions on nicotine product samples to minors.

• Expands enforcement authority by allowing tobacco product and nicotine product enforcement officers to issue citations, requires age verification for mail/Internet orders with specific procedures, and establishes criminal penalties for selling to minors and civil penalties for minors purchasing products.

• Establishes signage and point-of-sale requirements for retailers selling tobacco and nicotine products, including mandatory age verification calendars and conspicuous warning signs.

• Preempts local regulation by declaring that minimum age requirements and marketing/sale/delivery regulations for tobacco and nicotine products are matters of state authority; effective December 1, 2021.
