HB 1077 Summary

• Prohibits public employers, employment agencies, and private employers from requesting wage or salary history from current, former, or prospective employees as a condition of being interviewed, considered for employment, or promoted.

• Prohibits employers and employment agencies from seeking wage or salary history from a current or former employer, except when a prospective employee voluntarily provides prior wage information to justify a higher salary request.

• Prevents retaliation against employees or applicants who refuse to provide wage history or file complaints alleging violations of this prohibition.

• Allows employees to voluntarily disclose their wage or salary history for negotiation purposes without restriction.

• Becomes effective July 1, 2021.
