Creates section 250.475, Florida Statutes, known as the "Defend the Guard Act," prohibiting release of the Florida National Guard or members into active duty combat without a declaration of war by Congress or official action under Article I, Section 8, Clause 15 of the U.S. Constitution

Defines "active duty combat" as participation in armed conflict, performance of hazardous service in a foreign state, or performance of duty through an instrumentality of war in active federal military service

Defines "official declaration of war" as a declaration made by Congress pursuant to Article I, Section 8, Clause 11 of the U.S. Constitution

Requires the Governor to take all necessary actions to comply with the prohibition on mobilizing the Florida National Guard into active duty combat without proper Congressional authorization

Takes effect upon becoming law
