HB 1259 Summary: Community Recall Act

• Amends Florida Statute 720.303 to revise the process for recalling homeowners' association board directors, replacing the majority voting requirement with a 60 percent petition threshold from parcel owners whose parcels are their homesteads.

• Requires the board to hold a referendum meeting within 5 business days after receiving a recall petition, with all members voting on whether to certify the recall.

• Allows members to recall directors by written agreement or ballot without a membership meeting, or at a special meeting called by 10 percent of parcel owners if permitted by governing documents.

• Establishes binding arbitration procedures when the board declines to certify a recall, with disputes resolved under sections 718.112(2)(j) and 718.1255.

• Prohibits the division from accepting recall petitions when fewer than 60 days remain until a board member's scheduled reelection or within 60 days of their election.

• Takes effect July 1, 2021.
