• Department of Highway Safety and Motor Vehicles must establish fees for specialty license plates marketed and sold by private vendors that recover all reasonable costs associated with evaluation, implementation, and enforcement of vendor contracts.

• Private vendor contracts for marketing and sale of specialty license plates are payable only from fees collected under the department's fee-setting authority, not from other sources.

• Excess specialty license plate fees collected beyond the minimum amounts required and any negotiated vendor payments must be deposited into the General Revenue Fund.

• Specialty license plates marketed and sold by private vendors must be approved for terms of 1, 3, 5, or 10 years and can be cancelled or discontinued by the department if determined to be in the best interest of the state or motoring public.

• Act takes effect on the same date as HB 1267 or similar legislation, if adopted in the same legislative session and becomes law.
