The Department of Highway Safety and Motor Vehicles shall establish a secure system for issuing optional digital proofs of driver licenses and identification cards, and may contract with private entities to develop an electronic credentialing system.

The electronic credentialing system may not retain Internet protocol addresses, geolocation data, or location information that describes the device or network used to access the system.

A digital proof can comprise a limited profile containing only information necessary for a specific transaction, notwithstanding design and information requirements for physical licenses and identification cards.

Private entities that scan digital proofs are prohibited from storing, selling, or sharing personal information unless individuals consent in writing after being informed what data is collected and how it will be used; violations subject to civil penalty up to $5,000 per occurrence.

Licensees may present digital proofs of driver licenses to law enforcement in lieu of printed licenses, but must present the printed license if the officer cannot immediately verify the digital version; effective date is July 1, 2021.
