HB 1323 Summary

• Amends Florida Statutes section 790.401 to add procedural protections for respondents in risk protection order hearings

• Entitles respondents to legal representation and mandates appointment of counsel for indigent respondents under section 27.40

• Grants respondents the right to request a jury trial for decisions to grant or extend risk protection orders (excluding temporary ex parte orders), with juries composed of 12 persons

• Takes effect July 1, 2021
