Effective January 1, 2022, food outlets, food service establishments, and schools generating at least 104 tons of food waste annually must recycle that waste at authorized composting facilities, anaerobic digestion facilities, or other authorized recycling methods.

Effective January 1, 2023, educational facilities generating at least 52 tons of food waste annually must recycle that waste using the same authorized methods.

Recycling requirement only applies if a facility is located within 15 miles of an authorized composting or anaerobic digestion facility with available capacity.

The Department of Agriculture and Consumer Services may waive recycling requirements if county solid waste disposal fees are lower than food waste recycling fees at all facilities within 15 miles.

Act takes effect July 1, 2021.
