HB 1415 Summary

• Requires applicants unable to provide a social security card to submit proof of a number associated with an identity document, and expands acceptable identity documents to include foreign government-issued passports, birth certificates, consular identification documents, national ID cards, driver licenses, school documents, court documents, income tax returns, and marriage/divorce licenses.

• Reduces validity period for driver licenses issued based on certain foreign documents or nonimmigrant classification documents from 8 years to 1 year, or until the document expires, whichever occurs first; licenses based on other identity documents remain valid for 8 years.

• Prohibits the Department of Highway Safety and Motor Vehicles from disclosing photographs and personal information to immigration enforcement agencies (U.S. Immigration and Customs Enforcement, U.S. Customs and Border Protection, or successors) without a lawful court order; requires notification to affected individuals within 3 days of information requests.

• Requires persons and entities receiving driver license information to certify they will not use it for civil immigration purposes and to maintain records of information use for 5 years, available for department inspection.

• Prohibits discrimination against individuals based on holding a non-REAL ID compliant driver license and prohibits employers from requiring employees to present a driver license unless required by law.

• Effective date: July 1, 2021.
