CS/HB 1475 Summary

• Creates the "Fairness in Women's Sports Act" requiring interscholastic, intercollegiate, intramural, and club athletic teams sponsored by public schools or institutions to be designated based on biological sex as males/men/boys, females/women/girls, or coed.

• Prohibits athletic teams designated for females from being open to male students and requires schools to resolve sex disputes by requesting health examination documentation from a student's health care provider verifying biological sex through reproductive anatomy, genetic makeup, or testosterone levels.

• Protects educational institutions from adverse actions by governmental entities, licensing or accrediting organizations, and athletic associations or organizations for maintaining separate sex-specific athletic teams.

• Provides private causes of action for students deprived of athletic opportunities, students subject to retaliation for reporting violations, and schools harmed by violations, with remedies including injunctive relief, monetary damages for psychological/emotional/physical harm, and attorney fees.

• Establishes a 2-year statute of limitations for civil actions brought under this section, effective July 1, 2021.
