HB 7009 Summary

• Removes the scheduled October 2, 2021 repeal of the public records exemption for juvenile criminal history information compiled by the Criminal Justice Information Program from intrastate sources under section 943.053, Florida Statutes.

• Removes the scheduled October 2, 2021 repeal of the provision in section 985.04, Florida Statutes that specifies arrest records of juvenile offenders charged with or convicted of felonies are not exempt from public records requirements.

• Maintains confidentiality exemptions for juvenile criminal history records only when the juvenile was taken into custody, charged, found to have committed a felony-level offense, or transferred to adult court, and the record has not been expunged or sealed.

• Allows criminal justice agencies, the person to whom the record relates, their attorney, parents/guardians, and specified agencies to access juvenile criminal history information; non-criminal justice agencies and private sector may access non-exempt information upon providing personal identifying information and payment of fees.

• Takes effect October 1, 2021.
