SB 124 — Residential Swimming Pool Safety ("The Kacen's Cause Act")

• Increases the minimum number of required pool safety features for new residential swimming pools from one to two (out of five options: pool enclosure/barrier, safety cover, exit alarms, self-closing/self-latching doors, or pool water alarm) in order to pass final inspection and receive a certificate of completion
• Prohibits a property owner from transferring ownership of a parcel that includes a swimming pool unless the pool meets at least two of the five specified safety feature requirements
• Requires home inspectors to include in their written reports any pool safety features present for properties with swimming pools
• Adds specific ASTM and Underwriters Laboratories standards that pool safety features must meet, including standards for removable mesh fencing (ASTM F2286), safety covers (ASTM F1346), and pool alarms (UL 2017)
• Reclassifies violations from a second-degree misdemeanor (criminal penalty) to a noncriminal violation, with penalties waived if the owner installs the required safety features and attends a drowning prevention education program within 45 days of citation
