Hospitals operating Class II or Class III institutional pharmacies may dispense prescribed medicinal drugs to emergency department patients or inpatients upon discharge when a prescriber determines the drug is warranted and community pharmacy services are not readily accessible

The allowable supply of dispensed medicinal drugs is increased from the previous 24-hour limit to up to 48 hours or through the end of the next business day, whichever is greater

In areas where a state of emergency has been declared under s. 252.36, the dispensing limit is extended to up to a 72-hour supply

Prescribers may provide patients with an additional prescription for the medicinal drug beyond the initial dispensed supply if they determine continued use is warranted, with any controlled substance prescribing required to comply with ss. 456.44 and 465.0276

Effective date is July 1, 2021
