SB 382 – Clerks of the Court

• Defines "court record" for purposes of clerk service charges to include progress dockets, transcripts, documentary exhibits, electronic records, video recordings, and stenographic tapes filed with or generated by the clerk
• Creates a two-tier service charge structure distinguishing between court records and non-court records, with court record charges requiring partial remittance to the General Revenue Fund while non-court record charges of equal amounts are retained entirely by the clerk
• Requires clerks acting as county recorders to retain service charge payments for non-court-related functions, while distributing court-record-related charges for court-related functions as defined in s. 28.35(3)(a)
• Revises the jury cost reimbursement process by requiring clerks to submit quarterly reimbursement requests to the Florida Clerks of Court Operations Corporation for review, which then forwards approved amounts to the Justice Administrative Commission for payment, replacing the prior system of quarterly estimates and fund apportionment
• Restructures appellate filing fee distribution so that county-to-circuit court appeal fees (up to $280) no longer require a $20 remittance to General Revenue, while county/circuit-to-appellate court fees (up to $100) retain the $20 General Revenue remittance
