Department of Highway Safety and Motor Vehicles shall establish a secure system for issuing optional digital proofs of driver licenses and identification cards, with authority to contract with private entities for development.

Digital proofs may display limited profiles containing only information necessary for specific transactions and must verify authenticity; the electronic credentialing system cannot retain internet protocol addresses, geolocation data, or location information.

Individuals must satisfy all requirements for a printed driver license or identification card before receiving a digital proof; digital driver licenses cannot be issued if driving privileges are suspended, revoked, disqualified, or expired.

Private entities scanning digital proofs are prohibited from storing, selling, or sharing personal information unless individuals provide informed consent; violations subject entities to civil penalties up to $5,000 per occurrence, with an exception for financial institutions.

Law enforcement can request a printed driver license if unable to immediately verify a digital proof; manufacturing a false digital proof is a felony of the third degree and possessing one is a misdemeanor of the second degree.
