Authorizes adult children who were under court-appointed guardianship to file claims for medical negligence on behalf of a deceased parent, or allows their personal representative to file on their behalf.

Authorizes parents who were appointed guardians over an adult child to file claims for medical negligence following the adult child's death, or allows their personal representative to file on their behalf.

Exempts certain negligence claims under sections 400.023, 400.0235, and 429.295 (relating to nursing homes and assisted living facilities) from the medical malpractice limitations in section 768.21.

Clarifies that wrongful death damages under subsections (3) and (4) of section 768.21 are only recoverable for medical negligence claims by these previously-appointed guardians or their personal representatives.

Takes effect July 1, 2021.
