CS for CS for SB 1876: Relief from Burdens on Real Property Rights

• Reduces notice period for property owners to present claims against governmental entities from 150 days to 90 days before filing suit under the Bert J. Harris, Jr., Private Property Rights Protection Act

• Expands the definition of "real property" to explicitly include surface, subsurface, and mineral estates, clarifying that property rights protections apply to all estate types

• Establishes a presumption that settlement offers made by governmental entities protect the public interest, streamlining dispute resolution

• Allows property owners to bring claims without submitting formal development applications or permits when regulatory impact is clear and unequivocal, eliminating wasteful application requirements

• Permits property owners to bring actions to declare prohibited exactions invalid at any time such exactions are imposed or required as a final condition of approval

• Effective date July 1, 2021 for amendments to claims procedures and October 1, 2021 for the overall act
