Mandates fetal remains from surgical abortions be disposed of by cremation or interment, with the pregnant woman choosing the method and location or the abortion clinic making the determination if the woman declines.

Requires abortion clinics to pay for cremation or interment unless the pregnant woman chooses a location other than one provided by the clinic, in which case she bears the costs.

Requires abortion clinics to develop written policies and procedures for fetal remains disposal, maintain documentation of disposition methods, and provide operators of crematory facilities with properly executed notification forms before cremation occurs.

Establishes misdemeanor first-degree penalties for knowing violations involving failure to humanely dispose of fetal remains and provides immunity from liability for persons acting in good faith compliance with the disposal requirements.
