Courts may permit offenders age 25 or younger to enlist in the Armed Forces in lieu of incarceration if they meet specified criteria.

Eligible offenders must have a misdemeanor as primary offense with maximum possible imprisonment of 4 years or less, no prior disqualifying convictions, and no minimum mandatory sentence requirement.

Offenders must achieve a minimum acceptable score on the ASVAB test, successfully complete basic training and first term of enlistment, and satisfy all fines and financial obligations by completion of first enlistment.

Courts retain jurisdiction over the offender until all military service requirements are completed; offenders who fail to meet any requirement must return for resentencing.
