CS/CS/CS/HB 399 Summary

• Prohibits driving in street takeovers, stunt driving, racing, drag racing, speed competitions, or exhibitions of speed/acceleration on highways, roadways, or parking lots, with penalties of $500-$1,000 fine and 1-year license revocation for first offense.

• Prohibits participating in, coordinating via social media, or being a spectator at prohibited racing events; prohibits operating vehicles to film/record such events (except bona fide news media) or to fuel vehicles involved in such events.

• Increases penalties for repeat violations within 5 years: second offense carries $1,000-$3,000 fine and 2-year license revocation; third or subsequent offense carries $2,000-$5,000 fine and 4-year license revocation.

• Authorizes law enforcement to arrest without a warrant and impound vehicles for 30 business days; allows forfeiture of vehicles for repeat offenders under the Florida Contraband Forfeiture Act.

• Makes violations of illegal lighting laws (s. 316.2397) a first-degree misdemeanor when used to effect a vehicle stop; allows courts to consider light violations as evidence in false personation cases.
