Deletes subsection (4) of section 400.0238, F.S., which required punitive damages awarded in nursing home claims to be equally divided between claimants and the Quality of Long-Term Care Facility Improvement Trust Fund.

Deletes subsection (4) of section 429.298, F.S., which required punitive damages awarded in assisted living facility claims to be equally divided between claimants and the Quality of Long-Term Care Facility Improvement Trust Fund.

Modifies section 400.0239, F.S., to remove proceeds from punitive damages as a funding source for the Quality of Long-Term Care Facility Improvement Trust Fund, limiting funding to legislative appropriations, gifts, endowments, charitable contributions, and federal nursing home civil monetary penalties.

Effective July 1, 2022.
