Notices for HOA board meetings must specifically identify agenda items, and deposits collected from members (e.g., for construction) must be maintained separately from other association funds, with an accounting provided within 7 days of request and unused funds returned within 30 days of project completion.

Directors or officers charged by information or indictment with forgery of ballots, theft/embezzlement of association funds, destruction of official records, or obstruction of justice must be removed from office and are barred from accessing official records of any association while charges are pending, unless authorized by court order.

Fines for violations of HOA declarations, bylaws, or rules are capped at $100 per violation and $1,000 in aggregate (unless governing documents provide otherwise), and parcel owners must receive at least 14 days' notice at their designated address before a fine or suspension hearing, with the right to attend by telephone or other electronic means.

Directors and officers appointed by a developer must annually disclose their relationship to the developer, and all directors and officers must disclose potential conflicts of interest at least 14 days before voting on related issues, with a rebuttable presumption of conflict if undisclosed contracts or business relationships exist.

Fraudulent voting activities in HOA elections—including ballot tampering, voter intimidation, bribery, and false oaths—are classified as first-degree misdemeanors, effective October 1, 2023.
