CS/HB 1263 - Criminal Sentencing

• Prohibits Criminal Punishment Code points from being assessed for community sanction violations resolved through an alternative sanctioning program.

• Requires probation officers to use alternative sanctioning programs (default method) for low-risk technical violations unless directed by the court to file violation affidavits.

• Establishes 20-day hearing deadline for alleged low-risk violations, with automatic release without bail if no hearing is held within that timeframe.

• Limits first-time revocations for technical violations to mandatory modification or continuation of probation (up to 90-120 days county jail) for non-violent offenders without prior violations.

• Takes effect October 1, 2023.
