CS/CS/HB 1317 Summary

• Creates section 553.8991, the "Resiliency and Safe Structures Act," establishing state preemption over local regulation of certain structures including nonconforming coastal structures and those deemed unsafe by building officials.

• Prohibits local governments from blocking demolition of qualifying structures (except for public safety reasons) and limits demolition permit review to compliance with Florida Building Code, Florida Fire Prevention Code, and Life Safety Code.

• Requires local governments to authorize replacement structures at maximum height and size allowed by local regulations, and prohibits requiring replication of demolished structures or imposing additional regulatory requirements beyond those for similarly situated vacant parcels.

• Prevents local governments from imposing additional public hearings or administrative processes on demolition or replacement development applications that would not apply to comparable vacant properties.

• Applies retroactively to any conflicting local laws, voids any local government law contradicting the act, and prohibits penalizing owners or developers for actions taken under this section; takes effect upon becoming law.
