Creates first-degree felony with mandatory 3-year minimum sentence for selling, manufacturing, or possessing with intent to distribute fentanyl, carfentanil, alfentanil, sufentanil, fentanyl derivatives, or controlled substance analogs when the substance is in a form that resembles food products (candy, gummies, vitamins) or contains trademarks, copyrights, or cartoon characters

Establishes trafficking in dangerous fentanyl or fentanyl analogues offense with mandatory minimum sentences: 7 years for 4-14 grams, 20 years for 14-28 grams, and 25 years for 28+ grams, with corresponding fines of $50,000-$500,000

Adds enhanced penalty of 25 years to life imprisonment with $1 million fine for persons 18+ who knowingly sell or deliver fentanyl products designed to resemble food or candy to minors

Maintains existing trafficking penalties for morphine, heroin, hydrocodone, codeine, and oxycodone, with life imprisonment for 30+ kilograms and capital felony for deaths resulting from trafficking or importation

Takes effect October 1, 2023
