CS/CS/HB 1421 Summary

• Prohibits physicians from providing gender clinical interventions (including sex reassignment surgeries and puberty-blocking or hormone therapies) to minors, with limited exceptions for those continuously receiving such therapies between January 1, 2023 and July 1, 2023 and for medically verifiable disorders of sexual development.

• Requires immediate license suspension for health care practitioners arrested for providing gender clinical interventions to minors, and allows license revocation if violations are determined; violations constitute a third-degree felony.

• Prohibits state agencies, political subdivisions, and public institutions from expending funds to provide or reimburse for gender clinical interventions.

• Restricts birth certificate sex changes to scrivener's errors or cases of unresolvably ambiguous external biological sex characteristics at birth; prohibits changes based on gender identity perception.

• Bars health insurance policies and health maintenance contracts from covering gender clinical interventions, and establishes liability for physicians providing such interventions with 30-year statute of limitations for civil actions and removal of punitive damages caps.

• Effective date: July 1, 2023.
