CS/CS/HB 1489 Summary

• Designates the Brevard Barrier Island Area in southern Brevard County as an area of critical state concern, extending from the southern boundary of Melbourne Beach south to Sebastian Inlet State Park.

• Establishes guiding principles for development in the area including preventing shoreline hardening, protecting sea turtle habitat, prioritizing water quality restoration in the Indian River Lagoon, and protecting coastal and upland resources.

• Requires state, regional, and local agencies to coordinate plans and regulatory activities consistent with the designated area's protective principles and the legislative intent to establish sustainable land use management.

• Allows removal of the designation beginning November 30, 2030 if the state land planning agency determines all six conditions are met, including adequate beach/dune preservation, seagrass recovery, water quality improvements, sea turtle delisting, adequate local regulations, and local government approval.

• Takes effect July 1, 2023 and does not affect existing zoning or land use in the area prior to that date.
