CS/HB 1549 Summary

• Creates a public records exemption for information related to Department of Legal Affairs and law enforcement investigations of data privacy violations under sections 501.173 and 501.1735.

• Designates all such information as confidential and exempt while investigations are active, with limited exceptions for official duties, public notifications about data breaches, and disclosures to other governmental entities.

• Requires certain information to remain confidential even after investigations complete, including: information covered by other public records exemptions, personal information, computer forensic reports, data security vulnerabilities, and proprietary information/trade secrets.

• Defines "proprietary information" as information owned by entities that is treated as private, not publicly disclosed, and includes trade secrets and competitive interests per section 688.002.

• Subjects the exemption to the Open Government Sunset Review Act and automatically repeals it on October 2, 2028, unless the Legislature reenacts it before that date.
