Sarasota County is directed to pay $5.75 million to Kristin A. Stewart (in addition to $200,000 already paid) for injuries sustained when a county employee's utility truck struck her while she was jogging in a pedestrian crosswalk on May 13, 2020.

The total settlement amount of $5.95 million compensates Ms. Stewart for severe injuries including degloving wounds, pelvic fracture, liver laceration, lost career earnings of $1,927,498, lifetime medical care costs of $388,538, and permanent scarring and disability.

Sarasota County waives and extinguishes all lien interests related to Ms. Stewart's care and treatment, excluding federal portions of Medicaid liens which she must satisfy under Florida law.

Attorney fees are capped at 25 percent of the first $2 million recovered and 20 percent of amounts exceeding $2 million; lobbying fees may not exceed 5 percent of total recovery; costs or similar expenses are capped at $88,709.64.

The bill declares this settlement as sole compensation for all present and future claims arising from the accident and becomes effective upon enactment.
