SB 690 – Damages Recoverable in Wrongful Death Actions

• Repeals Florida Statute 768.21(8), which prohibited adult children from recovering lost parental companionship, instruction, guidance, and mental pain and suffering damages in medical negligence wrongful death suits
• Removes the prohibition preventing parents of deceased adult children from recovering mental pain and suffering damages in medical negligence wrongful death claims
• Amends sections 400.023, 400.0235, and 429.295 (governing nursing homes and assisted living facilities) to remove cross-references to the repealed restriction, while maintaining that actions under those parts are not classified as medical malpractice claims
• Sponsored by Senator Book with a proposed effective date of July 1, 2023
