Municipalities and counties are prohibited from banning or unreasonably restraining private entities from providing recycling or solid waste management services to commercial, industrial, or multifamily residential properties, including condominiums

Local governments may require private entities to obtain a permit, license, or nonexclusive franchise equivalent, but the cost may not exceed the administrative cost of issuance and must be commensurate with fees in other industries

Any franchise fee in place must be applied equally to all permit, license, or nonexclusive franchise equivalent holders

Existing contracts or franchises in place as of January 1, 2023, must be recognized and protected until their current expiration date; contracts with a renewal option during the 2023 calendar year may be recognized, but evergreen contracts or additional renewals/extensions are not permitted

The act has an effective date of July 1, 2023
