Creates new first-degree felony with mandatory minimum 3-year prison sentence for selling, manufacturing, or possessing with intent to distribute fentanyl, carfentanil, alfentanil, sufentanil, fentanyl derivatives, or their analogs when in disguised form (resembling food products, branded items, candy, vitamins, or containing cartoon characters).

Adds enhanced penalties for adults age 18+ who sell or deliver at least 4 grams of disguised fentanyl substances to minors, requiring mandatory minimum 25 years to life imprisonment and $1 million fine.

Establishes new trafficking offense for fentanyl and fentanyl analogs with quantity-based mandatory minimums: 7 years for 4-14 grams, 20 years for 14-28 grams, and 25 years for 28+ grams.

Applies same disguised substance penalties to the fentanyl trafficking statute, creating consistency between the two new offenses.

Takes effect October 1, 2023.
