Reduces minimum service area requirement for food service establishments from 2,500 to 2,000 square feet and seating capacity from 150 to 120 persons to qualify for special beverage licenses.

Adds requirement that food service establishments must hold themselves out as a restaurant and have at least 120 physical seats available for patrons during operating hours.

Modifies beach or cabana club license requirements by allowing locker rooms or bathroom facilities (instead of requiring locker rooms with facilities) and defining the required restaurant as a public food service establishment rather than specifying seat count.

Exempts food service establishments licensed under section 561.20(2)(a)4 from the 40 percent food and nonalcoholic beverage charge requirement for off-premises alcoholic beverage sales.

Effective date: July 1, 2023.
