SB 1522 - HIV Prevention Justice Act

• Reduces criminal penalty for HIV-positive individuals who donate blood, plasma, organs, or tissue from felony of the third degree to misdemeanor of the first degree, unless medically appropriate as determined by a licensed physician.

• Adds HIV to the list of sexually transmissible diseases and redefines prohibited sexual conduct to require either intent to transmit the disease or engaging in sexual conduct posing substantial risk of transmission when the other person is unaware of the person's HIV status.

• Creates an affirmative defense for individuals who comply in good faith with treatment regimens or behavioral recommendations (including use of prophylactic devices) prescribed by healthcare providers or public health officials, and specifies that failure to comply does not automatically establish intent to transmit.

• Reduces criminal transmission of HIV penalty from felony of the third degree to misdemeanor of the first degree for offenders who commit a second or subsequent enumerated offense after positive HIV test disclosure.

• Removes donation of blood, plasma, organs, or tissue under section 381.0041(11)(b) from the list of offenses triggering mandatory HIV testing requirements under criminal transmission statutes.
