CS for SB 1674 - Safety in Private Spaces Act

• Requires covered entities (correctional institutions, educational institutions, juvenile facilities, and public buildings) to maintain restrooms designated for exclusive use by females and males, or alternatively provide unisex restrooms and changing facilities.

• Permits persons to enter opposite-sex restrooms or changing facilities only under specific circumstances: assisting children under 12, elderly persons, or persons with disabilities; law enforcement purposes; medical emergencies; maintenance when unoccupied; or when designated facilities are out of service and unoccupied.

• Establishes disciplinary procedures for prisoners, students, employees, and juveniles who willfully enter opposite-sex facilities and refuse to leave when asked, with criminal trespass charges applicable to non-affiliated persons.

• Requires covered entities to submit compliance documentation by April 1, 2024, with the Attorney General authorized to enforce the law beginning July 1, 2024, through civil actions seeking injunctive relief and fines up to $10,000 for willful violations.

• Directs the Department of Corrections, Department of Juvenile Justice, State Board of Education, and Board of Governors to adopt rules and regulations by January 1, 2024, to implement and enforce the act.
