SB 7064 Summary

• Creates a civil cause of action for human trafficking victims against adult theaters and their owners/operators who knowingly allow victims to work, with recovery of economic damages, noneconomic damages, punitive damages, attorney fees, and costs.

• Increases criminal penalties for adult theater violations from a first-degree misdemeanor to a third-degree felony for owners, operators, or managers who violate identity and age verification requirements.

• Directs proceeds from the sale of property forfeited in human trafficking convictions to first pay restitution to victims, with equal distribution among multiple victims and remaining proceeds distributed per the Florida Contraband Forfeiture Act.

• Requires judicial circuits to establish educational programs for persons convicted of or charged with soliciting prostitution, covering topics including the relationship between commercial sex demand and human trafficking, human trafficking impacts on victims, and coercion/consent/sexual violence.

• Establishes the Statewide Data Repository for Anonymous Human Trafficking Data at the University of South Florida to collect and analyze trafficking data from law enforcement and service providers beginning July 1, 2024, with annual reporting to state officials and automatic repeal on July 1, 2026 unless reenacted.
